With reference to your letter No. 38435 of the 15th
Kony ultimo, I am directed by Secretary Sir E. Grey to transmit
to you herewith copy of a despatch from His Majesty's
Consul General at Shanghai regarding the detention at
Hongkong of a consignment of munitions of war, said to
De intended for the use of the Chinese Government.
After careful consideration of the facts of the case
as reported, Sir E. Grey is advised that Sir E. Fraser's
action may legally be considered justifiable on the fol-
lowing grounde:-
By a proclamation of August 5th, British Steamships
are forbidden to carry from any foreign port to any other
foreign port any article on the list of contraband of
war unless the shipowner is satisfied that the articles
are not intended for use in the enemy country.
